Terms and Conditions

These terms and conditions define the rights and obligations of the Parties within the scope of reservations made through Korkdam (hereinafter the hotel or Korkdam or we) website. We kindly ask our Customers (hereinafter Customer or You) to read and understand our terms and conditions before completing their booking as by making a booking via our website, you also accept and agree to all terms and conditions.

  1. RESERVATION

A reservation is deemed to have been made upon the hotel’s acceptance of your reservation request. You may receive an acknowledgment of receipt by email after your reservation. You are solely responsible for your choice of services and the suitability of those services for your need. We cannot be held responsible in this respect.

The Customer does not acquire the right to be provided with specific rooms. The Parties to the contract are the hotel and the Customer. If a third party placed the order on behalf of the Customer, then that party shall be liable vis­à­vis the hotel for all obligations arising from the hotel accommodation contract as joint and several debtors together with the Customer, insofar as the hotel has a corresponding statement by the third party.

Rates published online are not valid for Group Bookings. A “Group Booking” is defined as a booking for 10 rooms/suites or more with the same or similar arrival and departure date.

In case of any reservation that has been identified as a Group Booking via Korkdam.com, the hotel reserves the right to contact the client in connection with special conditions and rates relating to Group Bookings.

In case of any reservation that has been identified as a Group Booking via Korkdam.com, the hotel reserves the right to refuse and cancel any such reservations if the client has not accepted the hotel’s applicable special booking conditions and rates. Exceptions to this is Group Bookings which are reserved via an authorised and dedicated booking link.

  1. Repudiation by Customer (Cancellation, Annulment)/Failure to Use Hotel Services (No Show)

Cancellation by the Customer of the contract concluded with the hotel requires the hotel’s written consent. If such is not given, then the price agreed in the contract must be paid even if the Customer does not avail himself of the contractual services.

This shall not apply with the breach of obligation of the hotel to take into account the rights, objects of legal protection and interests of the Customer, if holding to the contract is no longer reasonable or another statutory or contractual cancellation right exists. To the extent the hotel and Customer agreed in writing upon a date for a cost­free cancellation of the contract, the Customer may cancel the contract up to that date without incurring payment or damage compensation claims by the hotel. The Customer’s right of cancellation shall expire if he does not exercise his cancellation right in writing vis­à­vis the hotel by the agreed date.

Reservations with prepayment cannot be changed and/or cancelled in any way, and sums paid in advance as a deposit cannot be refunded. If rooms are not used by the Customer, the hotel must apply credit for the income from renting the rooms to other parties and also for saved expenses.

At its discretion, the hotel may demand the contractually agreed compensation and to make a flat­rate deduction for saved expenses. In this case, the Customer shall pay a percentage, determined by the hotel’s internal regulations, of the contractually agreed rate for lodging with or without breakfast. Guests departing before their booked check­out date will be charged for the remaining nights of the original reservation confirmation.

III. Hotel Stay, Room Availability, Delivery and Return

In the application of the regulation customers may be asked on arrival at the hotel to fill out a police registration card (or immigration form or both). For this purpose, Customers will be asked to provide identification so that a check can be made to decide if they need to complete the registration. The hotel may have some internal Regulations for Customer and you accept to be bound by and undertake to respect these regulations.

Our hotel offers WIFI access that allow you to connect to the internet. You undertake to ensure that computing resources made available by us are not used for any illegal purposes or in any way for reproduction, representation, provision or communication to the public work or object protected by copyright or related right such as texts, images photographs (and so on) without the authorization of the copyright holder when this authorization is required. You agree to be bound by all the terms and conditions of our WIFI provider.

Unless otherwise agreed in writing on the booking confirmation, you are entitled to check in at any time from 2:00 p.m on the agreed arrival date. The Customer does not have the right to earlier availability.

On the agreed date of departure, you shall kindly vacate your room(s) and make them available to the hotel no later than 12:00 noon unless otherwise agreed in writing. After that time, on the grounds of the delayed vacating of the room for use exceeding the contractual time, the hotel may charge 50 percent of the full accommodation rate for the additional use of the room until 6:00 p.m. (after 6:00 p.m.: 100 percent). The Customer is at liberty to show the hotel that it incurred no or much lesser claim to use damages. The hotel shall act to remedy upon knowledge thereof or upon objection without undue delay by the Customer. The Customer shall be obliged to undertake actions reasonable for him to eliminate the disruption and to keep any possible damage at a minimum.

The Customer shall notify the hotel immediately after gaining knowledge of the loss, destruction, or damage while in the hotel. Insofar as a parking space is provided to the Customer in the hotel garage or a hotel parking lot, this does not constitute a safekeeping agreement, even if a fee is exchanged. The hotel assumes no liability for loss of or damage to motor vehicles parked on the hotel’s property, nor the contents thereof.

Wake­up calls are carried out by the hotel with the greatest possible diligence. Messages, mail and merchandise deliveries for guests are handled with care. The hotel assumes no liability in this regard but will make its best effort to deliver, hold, and for a fee forward such items (on request).

V Agreement on evidence

Entry of the necessary bank details and acceptance of these terms and conditions and the reservation form constitute the contractual obligation between the hotel and the Customer.

VI Force majeure

We will accept no liability and will not pay any compensation where the performance of our obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond our reasonable control including, but not limited to, flood, earthquake, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water or other utility service.

VII Settlement of disputes and applicable law

In the event of a dispute relating to these terms and conditions, you should first contact our Customer services to attempt to resolve the dispute amicably.

These terms and conditions and any non-contractual obligations arising in connection with them are governed by the laws of the country where the hotel is located.

The courts of the country where the hotel is located have exclusive jurisdiction to determine any dispute arising in connection with these terms and conditions, including disputes relating to any non-contractual obligations.

VIII Web Site Information

While all reasonable efforts have been taken to ensure the accuracy of information on our website, we do not accept responsibility for errors or omissions and reserve the right to amend or cancel the arrangement features on our websites without notice. Please note that in certain circumstances, generic photographic images have been used to represent the general style of a particular hotel.

The content of the websites is our copyright and may not be copied, reproduced, published distributed or amended for any other purpose without our prior written consent.

Trademarks used on the websites are the property of the respective owners. Hyperlinks to third party websites are provided for your convenience. We shall not be held responsible for the content or use of third-party sites.

We comply with data protection legislation such as the Data Protection Act 2012 of Ghana, which regulates the processing of personal data relating to you and grants you various rights in respect of your personal data. The aim of this Privacy Policy is to inform you about how we will use your personal data you provide to us through this Website, in connection with hotel bookings, your stay at Korkdam hotel as well as personal data provided and/or collected by us through other channels. We also inform you about your rights under applicable data protection law with respect to the handling of your Personal Data by us. Before providing us with Personal Data we recommend that you read this Privacy Policy which also forms part of our Terms and Conditions that govern our hotel services.

We use this Personal Data to handle your reservation and to establish and fulfil our contract with you. This includes verifying your identity, taking guarantee and/or payment information, and sending stay-related and/or marketing communication.

We take the protection of your Personal Data very seriously and therefore have kept the mandatory required fields to a minimum.

  1. Newsletter and special offers

If you provide your contact information to us (e.g. when booking a service with us or when signing up for our newsletter via our Website), we may use this Personal Data to send you our newsletters and details of other special offers which may be of interest to you, based on previous interactions with us (e.g. bookings).

If you sign up for our newsletter via our Website, you are required to provide your email address only. When you sign up for the newsletter via our website, you will receive an email to reconfirm your interest in staying in touch (double opt-in). Any additional information is voluntary and will be used solely for a personalisation of the newsletter.

If you set up a KORKDAM LOYALTY membership/user account, we ask you to provide the following Personal Information:

  • Your date of birth
  • Your home address and phone number
  • Your language preference for email communication
  • Your email marketing preferences
  • We use your Personal Data to send you newsletters and special offers.

If you deactivate your account, your account will be set to inactive.

In our Korkdam Hotel Blog, we publish articles on travelling. The blog allows you to post public comments. If you submit a comment, it will be published with the corresponding blog post and your username. Posting comments on our blog is entirely voluntary.

When you comment on a blog post, we collect and store the following Personal Data:

  1. Processing of Personal Data to personalise your stay at Korkdam

We may collect and process Personal Data about you, if it is relevant for your stay in a Korkdam hotel or if it is in your interest. We may collect and process certain additional data to personalise your stay upon your express request and consent (please below under 3.a.).

  1. Your consent to our ‘Personalise your Stay’ option

You have the option to enable Korkdam to find out more about you to improve your unique and personal experience by opting for the “personalise your stay” option. Only if you have expressly consented to this option we are permitted to conduct further research on you, in particular on publicly available social media entries and the internet. We do not undertake any research, in particular on social media or the internet if we have not obtained your express consent for this option.

If you consent to the “personalise your stay” option we may undertake additional research and record and use the respective information to make your stay more personal. For example, we may collect information on your sports preferences such as in relation to golf or football to provide you, in our sole discretion, with relevant information in this regard (e.g. a golf course next to the hotel or a football match in proximity to the hotel), or

your social media profiles to find out your favourite flowers or wine to allow us to provide you, in our sole discretion, with comforts or other conveniences tailored to you.

We will not collect any information which is embarrassing to you or inappropriate under, or not compliant with, local standards, conventions and habits or which are incorrect.

You may withdraw your consent at any time for the future by contacting us under the details of the contact section below.

  1. Personal data collection without your express consent

If you have not provided your express consent to the “personalise your stay” option, we do not undertake additional research and do not record and use respective information. In such cases, the Personal Data we collect is limited to information we have gained from you personally or by hotel personnel during your stay at the hotel and to information which is relevant for the stay at a Korkdam hotel (e.g. preferences to rooms, beds, food, and wine if obtained at the hotel). We do not undertake any additional research on you in this case, in particular, no research on social media or the internet.

III. Sharing Personal Data

Your Personal Data may be shared:

Within the Korkdam group and with our Korkdam hotels to establish and fulfil our contract with you or to the extent you consented to such sharing of data, for example. This includes verifying your identity, taking payments getting in contact and communicating with you.

With our commercial partners in the event that you book an event or an activity organised by such commercial partners.

With our third-party service providers who process your data on our behalf. Korkdam’s third party service providers hosting providers and providers of data analysis, IT services, and other similar services requested by Korkdam to provide the Website and other business-related services to you. Any data processing on our behalf complies with the applicable laws.

We will not transfer your personal data to third-party recipients unless you consent to such transfer of data or such transfer is permitted under applicable law.

  1. Transfer of Personal Data to a third country

Where information is transferred outside Ghana, we will ensure that appropriate safeguards are implemented.

The external service providers are supervised by our Global Data Protection Manager in terms of compliance with these regulations.

In respect of the collection and use of your personal data, you may:

withdraw your consent at any time for example by unsubscribing from the newsletter under “data protection”, ask us whether we process Personal Data about you, for which purposes, the categories of Personal Data concerned, to which categories of recipients the information has been disclosed, where possible, the envisaged period for which the personal data will be stored (or, if not possible, the criteria used to determine that period), inquire with us about the appropriate safeguards relating to the transfer to a third party, ask us for a copy of the Personal Data undergoing processing and ask to receive your Personal Data in a structured, commonly used and machine-readable format and to transmit those data to another controller without any hindrance from us. request that the processing of your personal data is restricted by Korkdam, request not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

  1. Retention and deletion of Personal Data

We will retain your personal data only for a limited period of time needed to fulfil the purposes of processing mentioned above. After that time your personal data will be erased. If we process your personal data based on your consent, we will retain your personal data for a limited period of time needed to fulfil the purposes of processing it.

Where we enter into a contract with you, we will keep your information for the duration of the contractual relationship you have with us, and, to the extent permitted, after the end of that relationship for as long as necessary to perform the purposes set out in this notice. The criteria to determine the storage period are statutory and contractual requirements, the nature of our relationship with you, the nature of the data concerned and the technical requirements. Laws may require us to hold certain information for specific periods.

Where we process personal data for marketing purposes or with your consent, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests). We also keep a record of the fact that you have asked us not to send you direct marketing or to process your data so that we can respect your request in future.

In other cases, we may retain data for an appropriate period after any relationship with you ends, to protect ourselves from legal claims, or to administer our business.

When staying with children at any Korkdam hotel world-wide you may benefit from:

  • Children up to 6 years may share their parent’s room at no extra charge
  • Children between 6 and 12 years benefit from a 50% discount on the extra bed charge
  • Breakfast is complimentary for children under 6 years
  • Children from 6-12 years receive a 50% discount on breakfast, unless already included in the room rate.
